Privacy Policy

Your privacy is fundamental to how we build ModeAI. This policy explains what data we collect, why we collect it, and how you remain in control of it.
1. Information We Collect
We collect information you provide directly, information generated as you use ModeAI, and limited technical information required to operate the service.
Information you provide:
- Account information: email address and display name when you register.
- Content you create: prompts, generated images, videos, voice recordings, and conversation history.
- Payment information: processed entirely by Apple via In-App Purchase. ModeAI never receives or stores card details.
- Support communications: messages you send to our support team.
Information generated automatically:
- Usage data: features used, session duration, and interaction patterns.
- Device information: iOS version, device model, and app version for diagnostics.
- Crash reports: anonymized stack traces to help us fix bugs.
- On-device AI inference logs: when using local models, all processing stays on your device and is never transmitted.
2. How We Use Your Information
We use collected information to:
- Provide, maintain, and improve ModeAI features and performance.
- Sync your projects and content across your devices via your account.
- Process your AI requests using our cloud models (Chat, Image, Video, Voice).
- Send transactional notifications such as generation completions or account alerts.
- Detect and prevent fraud, abuse, and security incidents.
- Comply with legal obligations.
We do not sell your personal information to third parties, and we do not use your content to train our AI models without your explicit opt-in consent.
3. On-Device AI & Local Processing
When you enable On-Device AI mode, all model inference runs locally on your iPhone using Apple Silicon. In this mode:
- Your prompts and outputs never leave your device.
- No data is sent to ModeAI servers or third-party AI providers.
- Conversations are stored only in the local app sandbox and are deleted when you clear history or uninstall the app.
4. Sharing Your Information
We share your information only in the following limited circumstances:
- Service providers: trusted vendors who help us operate ModeAI (cloud infrastructure, analytics, customer support) under strict data processing agreements.
- AI model providers: when using cloud modes, your prompt is transmitted to the relevant AI provider solely to generate your requested output.
- Legal requirements: when required by law, court order, or to protect the safety of users.
- Business transfers: in the event of a merger or acquisition, your data would be transferred subject to the same privacy commitments.
5. Data Retention
We retain your account and content data for as long as your account is active, or as needed to provide services. You may delete your account and all associated data at any time from Settings > Account > Delete Account within the app.
Anonymized, aggregated usage analytics may be retained for up to 24 months for product improvement purposes.
6. Children's Privacy
ModeAI is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we discover that a child under 13 has provided us with personal information, we will delete it promptly. If you believe a child under 13 has submitted information to us, please contact us at support@modeai.io.
7. Security
We use industry-standard security measures including TLS encryption in transit, AES-256 encryption at rest, and regular third-party security audits. No method of transmission or storage is 100% secure; we encourage you to use a strong password and enable Face ID or Touch ID within the app.
8. Your Rights
Depending on your location, you may have the following rights regarding your personal data:
- Access: request a copy of the data we hold about you.
- Correction: ask us to correct inaccurate or incomplete data.
- Deletion: request deletion of your personal data.
- Portability: receive your data in a machine-readable format.
- Objection: object to certain types of processing such as direct marketing.
- Restriction: ask us to restrict processing in certain circumstances.
To exercise any of these rights, visit Settings > Privacy in the app or contact us at support@modeai.io. We will respond within 30 days.
9. International Transfers
ModeAI operates globally. Your data may be processed in the United States and other countries where our service providers operate. We ensure appropriate safeguards — such as Standard Contractual Clauses — are in place for transfers outside your home country.
10. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes via an in-app notification or email at least 14 days before the change takes effect. Your continued use of ModeAI after the effective date constitutes acceptance of the updated policy.
